Margaret Spellings Margaret Spellings, Former Secretary of US Department of Ed.

Margaret Spellings was Secretary of Education during the second term of the George W. Bush administration. She is not an educator. She first came into contact with the issues of this case in March/April 2007 when Randy directly wrote to her. While she publically proclaimed a plan for accountable through accreditation and oversight in May 2007, her administration was actually mismanaged. By late 2007 it was understood that accreditation agencies such as ATS and NWCCU were not in compliance with 34 CFR § 602. ATS had been deeply involved in the fraud and misrepresentations being perpetrated by Western Seminary against Randy Chapel and his mother. Spellings chose to cover for ATS and NWCCU who were not in compliance with 34 CFR § 602, because her own administration was negligent in its' oversight functions on accreditors in the first instance. In doing so, the administration keep the two accreditation agencies out of court and directly interfered in two civil cases, to cover up the negligence and lack of oversight within her own administration and further the administration's non-legal supported agenda educational experts voiced concerns over.

After the Nancy C. Regan and Cheryl Oldham letters were written, letters from Randy Chapel, Carol Nye-Wilson and their attorney John Hannon were sent and directed to Margaret Spellings, Arne Duncan and others. Communications were ignored. Margaret Spellings and other employees committed negligent torts for failing to intervene to prevent further damage and injury to Randy Chapel and his family. Instead, these follow up employees acts were even crueler torts; having set Randy up for even greater damage and injury, which came and cannot be undone at this point.

Kent Talbert Kent Talbert, Former General Counsel of US Department of Ed.

Kent Talbert was the General Counsel for Margaret Spellings. Various communications, which were directed to Margaret Spellings, were also directed to Kent Talbert. As of this writing, the Department has not turned over any communications written to Kent Talbert or Margaret Spellings during various FOIA requests, and in spite of President Obama's and Mr. Eric Holder's written directions on the matter.

It should also be noted that Kent Talbert is also an attorney and thus had a much better understanding of the law than others in the administration. Failing to intervene to prevent further damage and injury to Randy Chapel and his family are even crueler torts; having set Randy up for even greater damage and injury, which came and cannot be undone at this point.

Cheryl Oldham Cheryl Oldham, Former Acting Assistant Secretary for Postsecondary Education.

Ms. Oldham replaced Diane Auer Jones and was the former Acting Assistant Secretary for Postsecondary Education while also serving as the Chief of Staff to the Under Secretary of Education. Current consultant at the Margaret Spellings & Company. Vice President, Institute for a Competitive Workforce at U.S. Chamber of Commerce, which is sponsored in part by Corinthian Colleges, Inc. It was Corinthian that was hit with a judgment of 6.5 million dollars by the State of California for civil wrongs against students and family members.

Cheryl Oldham is infamous for having sent out a letter at the direction of Margaret Spellings to Representative Mazie Hirono (D-HI) attempting to buttress the actions and determinations of the ASL as well as the letter written by Nancy C. Regan at the direction of Margaret Spellings (civil conspiracy and obstruction of justice). Unlike Margaret Spellings or Nancy C. Regan, Cheryl Oldham has a law degree. She of all people knew that the actions being taken were contrary to Federal and State laws, as well as decisional cases. To this end, while others committed intentional torts, Cheryl Oldham committed negligent torts as she failed to intervene to prevent further damage and injury to Randy Chapel and his family.

Diane Auer Jones Diane Auer Jones, Former Assistant Secretary for Postsecondary Education

Diane Auer Jones wrote the May citations to ATS and NWCCU, as well as a letter to Randy. She is a witness for several reasons. For example, while the Department was well aware that both ATS and NWCCU were not in compliance with 34 CFR 602.22, she did not note this in her May 2008 letters. This was covered up by the Spellings administration for the benefit of both the accredited agency and the administration itself.

Another point of interest is found in her citation letters, where she notes that, "litigation can be prolonged." The litigation had by that time being on going on and off since 2003, with the final so-called arbitration award on May 10, 2010. This cost Randy and his family hundreds of thousands of dollars, which could have been mitigated at any time by the Department. But due to the obstruction of justice and negligent torts of the Spellings administration, Randy has been left in a state that can never be fixed. Failing to intervene to prevent further damage and injury to Randy Chapel and his family are even crueler torts; having set Randy up for even greater damage and injury, which came and cannot be undone at this point.


Arne Duncan Arne Duncan, Secretary of Education

Arne Duncan was Secretary of Education during the first term of the Barack H. Obama administration. Unlike Spellings, Duncan comes from a family that is involved in education from a college professor to elementary and himself involved in education since his days in college and spending his afternoons in his mother's tutoring program learning first hand the challenges of urban education.

Secretary Duncan has been left a mess by the Spellings administration. First, material evidence shows that Western Seminary was repeatedly making misrepresentations to the agency and the Spellings administration was repeatedly negligent with their involvements with the school over a period of several years. Second, two accreditors were known to be in non-compliance with 34 CFR § 602, which at the heart was also due to the Spellings administration being repeatedly negligent with their oversight with the accreditors over a period of several years. Third, the Spellings administration sought to cover up its' own ongoing negligence by using the requirements of an unlawful agreement gained by coercion onto Randy and his family to Spellings' advantage, while doing this with public funds. Fourth, Spellings overstepped her authority, by directing Cheryl Oldham and Nancy C. Regan, with the involvement of the Office of General counsel to support the fraud and educational misrepresentations being perpetrated by Western Seminary and ATS against Randy and his family.

Secretary Duncan and his administration are now faced with various dilemmas both ethically and legally, which were brought on due directly to the negligence and compromising of the agency by the Spellings administration.


Charles P. Rose Charles P. Rose, Former General Counsel

Former General Counsel, U.S. Department of Education (last day July 8, 2011)

Charles Rose was the General Counsel during the Arne Duncan administration. Randy intentionally sent communications to Charles Rose that he also sent to Arne Duncan. These communications for a reason, have been sent mostly via certified letter, return receipt. Just as in the case of Cheryl Oldham and Kent Talbert, Charles Rose is an attorney and thus has a much fuller understanding of the law. To this end, while others committed intentional torts, Charles Rose could be seen as committing negligent torts if shown he failed to intervene to prevent further damage and injury to Randy and his family.


Philip Rosenfelt Philip Rosenfelt, Acting General Counsel

Mr. Rosenfelt has been left a mess and faces a further problem now as Acting General Counsel. Failing to intervene to prevent further damage and injury to Randy Chapel and his family are even crueler torts, which he as Acting General Counsel would be overseeing for the Department - since such failures will have set Randy up for even greater damage and injury. Thus, Mr. Rosenfelt leadership and action within the Department is very important to review concerning this case and is something to watch very carefully.


Chuck Mula Chuck Mula, Investigator

Chuck Mula is an investigator within the ASL. He was assigned the case. He and others are withholding materials of their actions against Randy Chapel and his family. Evidence already suggests an involvement in the obstruction of justice and torts acts against Randy Chapel and his family. While repeated requests for materials have been requested through the FOIA process, materials have not been produced one way or the other. He is known to work with others to manufacture documents. An issue concerning 34 CFR § 73 has already been noted concerning him.


John Barth John Barth, Former ASL Director

John Barth preceded Nancy C. Regan as director of the ASL. Randy wrote to John Barth and never got a response from him. This is what led Randy to write Margaret Spellings in March 2007. It is now known that there was a lot of turmoil within the ASL at that time. 3rd party sources report that he was replaced as a political move by the Spellings administration in late 2006/2007 time frame.


Nancy C. Regan Nancy C. Regan, Former ASL Director

Nancy C. Regan is infamous for having used ATS and NWCCU letters as a basis to claim that the ThM and for that matter the Settlement Agreement was valid. In spite of being confronted as to various problems she, and for that matter the Department were claiming were true – most of all given the false and misrepresentations by Sandra Elman's letter, Nancy C. Regan ignored Randy, his family and John Hannon's communications. Instead of preventing further damage and injury to Randy Chapel and his family, she and the Spellings administration stuck to their unsupportable positions. Her acts are even crueler torts; having set Randy up for even greater damage and injury, which came and cannot be undone at this point.


Kay Gilcher Kay Gilcher, Director Accreditation Division

Director of Accreditation Division (formerly called ASL). She took over when Nancy C. Regan was removed as director.


Carol Griffiths Carol Griffiths, AAEU Chief

Carol Griffiths works within the ASL. Her actions also dovetailed with Nancy C. Regan, Chuck Mula, Cheryl Oldham, Kent Talbert, Margaret Spellings, Sally Warner and others.


Regina Miles Regina Miles, FERPA Inspector

Ms. Miles is from the Family Compliance Office. She became involved in 2011 when Randy proceeded to note the FERPA violations and actions by Western Seminary and in the Award, which are contrary to the law. Ms. Miles asked if Randy wanted to file a complaint and was going to check if the 180-day limit could be waived. Randy informed Ms. Miles (and Secretary Duncan) that it was actually Spellings in 2008 that agreed that Randy was barred from filing complaints as a matter of earning an education. Western was given full rein to violate the federal law, due to Spellings directly.

Because of the actions of Spellings, Chuck Mula, Nancy C. Regan and others within the Department in 2008, Ms. Miles and the Family Compliance Office cannot prevent further damage and injury to Randy Chapel and his family. Barring the Family Compliance Office from taking action or investigation are even crueler torts; having set Randy up for even greater damage and injury, which came and cannot be undone at this point.


Edgar Mayes Edgar Mayes, Director of Correspondence and Communications Control Unit

Mr. Mayes is normally the person who receives communication sent to Secretary Duncan. It was Mr. Mayes who received the communications in the summer of 2010 concerning the FERPA violations and actions by Western Seminary and in the Award, which are contrary to the law. He noted that such information would be forwarded. It now appears that no one from the Family Compliance Office received anything in 2010.

Ms. Jessup has been a fixture in responding to Dale, Carol and Randy regarding various FOIA requests.


Maria-Teresa Cueva Maria-Teresa Cueva, FOIA Public Relations

Ms. Cueva took part in responding to Dale, Carol and Randy regarding various FOIA requests.


DeNise L. Hill DeNise L. Hill, FSA

DeNise L. Hill and Carol Nye-Wilson had various communications under various emails addresses of Carol. The Department has produced none of them to date. Headers clearly indicate communications originate from Dept mail servers and shall be used as proof. The DeNise L. Hill emails are of interest as they note that no school can cause a student not to complain. While DeNise L. Hill and California Attorney General Jerry Brown on behalf of the people of the state understand this point, the Spellings administration has no problem with schools writing clauses into contracts that bar students and family members from going to the government with complaints about civil wrongs.


Donna Wittman Donna Wittman, FSA

Donna Wittman had various communications noting that the program was offered in California and that the program was actually different than the one offered from Portland. The Department has produced no Donna Wittman communications to date, as the program offered to Randy was substantively different than the one, which is accredited and approved out of Portland. The Donna Wittman communications contradict the Department's position since 2008 against Randy and thus, are a known hazard to the Department's defense, just like the DeNise L. Hill communications.


Charles Love Charles Love, OCR-SF

Mr. Love was part of the failed OCR investigation in 2005, which failed to uncover that Western had in fact lied, made misrepresentations and backdated documents sent to the OCR during an investigation – which Randy noted Western does in his complaint. Backdating documents are a felony in CA. No known actions have been taken against Western by the Department, for Western's misrepresentations in 2005 during the OCR investigation.


Shane Dunne Shane Dunne, OCR-SF

Mr. Dunne was part of the failed OCR investigation in 2005, which failed to uncover that Western had in fact lied, made misrepresentations and backdated documents sent to the OCR during an investigation – which Randy noted Western does in his complaint. David Rolandelli David Rolandelli, OCR-SF

Linda Paulding Linda Paulding, OCR-SF

Ms. Paulding was part of the failed OCR investigation in 2005, which failed to uncover that Western had in fact lied, made misrepresentations and backdated documents sent to the OCR during an investigation – which Randy noted Western does in his complaint. Backdating documents are a felony in CA. No known actions have been taken against Western by the Department, for Western's misrepresentations in 2005 during the OCR investigation.


Sally Warner Sally Warner, Attorney OGC

Apparently Sally Warner was an attorney out of the Office of General Counsel working with Chuck Mula concerning the NWCCU letters in the summer of 2008. Due to the FOIA case Carol Nye-Wilson brought against the Department in 2008 and to which settled in 2009, evidence shows that Chuck Mula was actively engaged in leading the outcome of the NWCCU letter, which was later referenced by Nancy C. Regan. Sally Warner did not interven to stop such actions.


Harry Yee Harry Yee, Assistant United States Attorney

Assistant United States Attorney, Hawaii. Harry Yee was assigned to the FOIA case Carol Nye-Wilson brought in 2008 to force the Department to answer her FOIA. She continued her case and it was later settled. Harry Yee has direct knowledge that when settlement talks started with Carol, the Department refused to rescind the Nancy C, Regan and Cheryl Oldham letters as requested by Carol – having set Randy up for even greater damage and injury, which came and cannot be undone at this point.

To the extent that Harry Yee became knowledgeable of the acts, omissions, and injury that the Department was undertaken against Randy and his mother, he should have intervened to prevent further damage and injury to Randy Chapel and his family. He failed to and represented to Carol Nye-Wilson and her attorney at the time, that the Department would not rescind those letters, and simply furthered the tortuous acts by the Department.

Many are well aware of the sexual misconduct cover up of Steve Korch and his threats towards others who know. Because of the actions by the Spellings administration, Korch has now "earned" a Doctorate of Ministry, which likely would not have been possible. He has also been able to gain $25,000 under the table without paying taxes. He also proceeds to write up articles talking up how spiritual he is and so on, in order to counter and detract what people have really learned about him. He refuses to offer any help to his victim and continues to threaten anyone with knowledge of his background.

Lynn Ruark Lynn Ruark, Former Employee

Because of the actions by the Spellings administration, Lynn Ruark (with others) has completely destroyed students and their families. Lynn Ruark is now retiring. No statement has been made regarding taking action against him (or others) for the false and misleading statements to the Department.


Gary Tuck Gary Tuck, Instructor

Because of the actions by the Spellings administration, Gary Tuck (with others) has completely destroyed students and their families. Tuck continues on as if nothing happen. M. Tuck apparently is the only student in the country who is not required to follow Section 504 requirements in order to receive "accommodations." While G. Tuck is fully aware of Section 504, he and his son are above the law and expect that the Department to treat them as such. No statement has been made regarding taking action against him by the Department.


Randy Roberts Randy Roberts, President

Because of the actions by the Spellings administration, Randy Roberts (with others) has completely destroyed students and their families. Roberts with others worked with ATS to make up the various unsupportable claims regarding the Settlement Agreement and education for Randy Chapel. Roberts was also part of the ATS cover up with Wiggins and Downs. Roberts was also part of the false and misleading statements to the Department. No statement has been made regarding taking action against him.


Rob Wiggins Rob Wiggins, Registrar

Because of the actions by the Spellings administration, Rob Wiggins (with others) has completely destroyed students and their families. Wiggins is the poster child of what can go wrong when schools have full rein to destroy students. Wiggins with others worked with ATS to make up the various unsupportable claims regarding the Settlement Agreement and education for Randy Chapel. Wiggins was also part of the ATS cover up with Roberts and Downs. Wiggins was also part of the false and misleading statements to the Department. Wiggins was a part of many of the issues that have damaged Randy to the point of no return since 2002. No statement has been made regarding taking action against him.

Bert Downs Bert Downs, Former President

Because of the actions by the Spellings administration, Bert Downs (with others) has completely destroyed students and their families. Downs with others worked with ATS to make up the various unsupportable claims regarding the Settlement Agreement and education for Randy Chapel. Downs was also part of the ATS cover up with Roberts and Wiggins. Downs was also part of the false and misleading statements to the Department. Downs was a part of many of the issues that have damaged Randy to the point of no return since 2002. Downs was part of the cover up for Steve Korch. No statement has been made regarding taking action against him.


Dan Britts Dan Britts, Former Instructor

Dan Britts was the person who violated FERPA and spoke to Andy Lewis on the pretexts that he was "checking to see how Randy was doing." Dan Britts was also involved in the Kevin Ford scandal. After the Randy and Kevin issues, Britts went off to "serve God somewhere else."


Sandy Wilson Sandy Wilson, Former Instructor

Sandy Wilson, D. Min was part of the so-called "Student Development Committee" meeting. She was left in the dark as to what was really going on and was shocked to learn information that had been kept from her by Lynn Ruark, Rob Wiggins and others.

She is also known for writing a book with her husband Earl about him having affairs and using a "spiritual care team" to "restore Earl." This same care team approach was used on Kevin Ford, which nearly killed him. Kevin Ford ended up going to a cult-deprogramming center. Unlike Ford, Randy who knew about this, refused to take part in the spiritual abuse that Western is known for.


Roy Low Roy Low, Former Instructor

Rev. Roy Low, PhD. was Randy's professor for Hebrew and OT. It was Steve Korch, who violated FERPA and the school's privacy policy who talked to Gary Tuck. G. Tuck had no administrative need to be told anything. Subsequently, G. Tuck then proceeded to tell Roy Low what Steve Korch had told him. Randy complained noting that this was a violation of FERPA and Portland contacted Korch, Tuck and Low to stop. This is also when Ruark became involved.

Roy is also the person Randy spoke to regarding Debbie's actions.

Tom McEnroe Tom McEnroe, Instructor

Tom McEnroe was Randy's Greek teacher in the winter of 2002. There were various conversations between Randy and Tom concerning Debbie. There were also conversations between his wife and Randy. There was no doubt that Debbie was not the type of person Randy should be with.

Tom McEnroe also spoke to Carol Nye-Wilson after she had protested at the school concerning Steve Korch. Calvary Church in Los Gatos was stunned when Carol protested in from of the church were the school was located. The pastoral staff was told to provide any information they received to Western's attorneys. Tom McEnroe was the only one who would speak to Carol.

Added note: Tom (a friend of G. Tuck) was brought on after G. Tuck helped remove the former Greek teacher that G. Tuck did not like.


Jan Verbruggen Jan Verbruggen, Instructor

Jan Verbruggen, Phd. Verbruggen was the Director of Master of Theology studies.

Once Randy and Bill Dresser started in on asking more questions regarding the ThM, this caused problems with Western Seminary – because they had no answers: "At some point soon, we'll need to have a plan for how to respond to these ThM communications. But that will be part of the larger response."

Verbruggen broke rank when Justin Nye emailed him a question and he answered it truthfully.

"Nobody that I remember has ever substituted the Th.M. only classes with individualized studies. Individualized studies are not considered Th.M. only classes."

Verbruggen was not in on the scam being played out by Ruark, Wiggins, Roberts and Downs.

Daniel Aleshire Daniel Aleshire, Director

Daniel Aleshire was involved in and out over a period of several years. He is infamous for noting to Dale Wilson that ATS was not interested about Steve Korch's sexual misconduct being covered up by the school, the tax evasion by Korch and so on. Daniel Aleshire is a Baptist.


Jeremiah McCarthy Jeremiah McCarthy, Former Director

Jeremiah McCarthy was involved in and out over a period of several years on both Randy and Kevin's cases. Jeremiah McCarthy was going to be used by Western as an expert witness for the school. Famously, Jeremiah would waffle to Chuck Mula regarding the validity of the ThM.


Charles Willard Charles Willard, Former Director

Charles Willard was involved in 2005-2006 regarding the Settlement Agreement. Bert Downs noted ATS liaison involvement in 2008, but then said that ATS was not involved. Rob Wiggins and Randy Roberts also took part in this cover up.


Tisa Lewis Tisa Lewis, Director

Tisa Lewis is a witness because she had various email conversations with Charles Willard regarding the so-called ThM program to Carol.

Sandra Elman is President of NWCCU. Made false and misleading statements during federal investigation, which were later used by the Department to claim the degree and Settlement Agreement were valid. She also covered for Western Seminary.

Brotherhood Mutual claims to insure America's churches and related ministries for Liabilities.


GuideOne, Insurance Company

GuideOne claims to be the premier, niche-market insurer of educational institutions across the country. Guide One is a hassle to deal with and refuses to settle.


Tudor Insurance Co., Insurance Company

Professional Liability Errors And Omissions Insurance. Tudor dropped Western's insurance coverage during the underlying case, which led them to get Brotherhood Mutual.

Take note: Tutor claims that Western was to put in $50,000 on Oct 8, 2008. However the trust account from Boornazian, Jensen & Garthe dated April 24, 2009 only shows Western putting in $35,000 and then a payout about 6 weeks later to Steve Korch. This contradicts Sprinkles's handwritten notes on March 14, 2006. The money, regardless, is coming from Western Seminary, which everyone at Western repeatedly claimed no knowledge of. Western never put all the money in to the trust account in 2006. It only put in enough to settle. To this day, the $25,000, which was to be set-aside for Randy when he finished his ThM, never made it into the trust account – instead Western used the $25,000 of the $35,000 it placed in the trust account and gave it to Korch.

Tuck testified that all the defendants; the attorneys, insurance companies and Sprinkles were all in the room discussing Korch getting the $25,000. Western never intended Randy to ever achieve his degrees and had already planned on blocking Randy from earning an education and never receiving the $25,000. This is also noted as the goal of Western Seminary by Sprinkles prior to the settlement.

Once Western had the settlement agreement signed, they got what they really wanted: settlement with Korch, gagging Randy and Carol and enough hurdles to make it more difficult for Randy in the future. After that Korch was paid off, and Ruark, Wiggins, Roberts and Downs went to work to finish Randy off. Western recruited both ATS and NWCCU to deal with the Feds, who in turn had their own problems and were easily manipulated by Western.

(SB No. 71917) of McPharlin Sprinkles et al. Linda McPharlin was Steve Korch's and for a time Western Seminary's attorney. She was involved in the Settlement Agreement. At one point in 2006 she was also hired to represent Western Seminary.

Mark is villainous for his work with Sam Phillips when both attempted to claim that Steve Korch, who was 25 years old, married, attending "Bible school" and a youth pastor was committing sexual misconduct acts with Jane Doe, that are accepted in other countries. Western et al, and their attorneys were hit with a $1925 (CCP §128.7) fine. Mark advocates and teaches seminars concerning using "pleadings as a weapon in litigation."

David Eckman David Eckman, Instructor

Rev. David Eckman, PhD. Randy had him for several classes. He was an Administrative Dean prior to Steve Korch. What is interesting about him is that he fully admits to the fact that the school administration knew that the students (a number of them) were having sex outside of marriage – the so-called "moral-code" was actually non-existent. That is because Western Seminary as a business practice repeatedly graduated students. When Western acted against Randy that was an arbitrary and capricious exercise of authority, which often nails schools in the court. This arbitrary and capricious act has been treated by the courts routinely as a violation of the due process and rights of the student.

This plays into a major point, as Randy has become the student in the history of the school that the so-called "moral-code" applied too.

M. James Sawyer M. James Sawyer, Instructor

Rev. M. James Sawyer, PhD. Sawyer was the person who stuck up for Randy and the one that Randy expressed his remorse too. Western and their attorneys proceeded to harass and intimidate Sawyer because he was being helpful and against what Western et al was doing. This caused a rift between him and G. Tuck, a friend of his. Western got rid of him after the agreement was signed (summer 2006), even though he was contracted to provide instruction to Randy as a term of the agreement. Instead of making an issue of what they were doing to him, he went "quietly" because Western had threatened to not give him a good reference.

He now works as a missionary teacher at Sacred Saga Ministries (www.sacredsaga.org) and teacher in an out of area school. He basically keeps a low profile.


Debbie Godbey Debbie Godbey

(aka Debbie Brumbaugh, Debra Brumbaugh, Deb Brumbaugh, Deb Godbey).

She is the woman who believed that Randy was God's will for her life, claimed God said that Randy had to marry her and so on. She is now married to Paul Godbey. She was previously involved with other men, including Pastor Steven Stone (below). She would target men who were somehow involved in the church/ministry. She has now gone to the effort of removing any information she can about herself and her whereabouts from databases and the internet.


Steven Stone, Pastor

Pastor Steven Stone was sexually involved with a 20-year-old Debbie Brumbaugh when he was her youth pastor. Debbie Brumbaugh has made various statements as to the nature of how sexually involved she was depending on who she was talking to. Western played down Debbie Brumbaugh targeting men in church leadership and her involvement with Pastor Steven Stone, because they used Debbie to get at Randy.


Kevin W. Ford, former student

Kevin Ford is another student who was eviscerated by Western Seminary's business practices against anyone who gets in their way. He found Randy and Carol via the Portland Alliance newspaper article.

One of Kevin's 2003 winter term courses required each student to do a project with a real ministry problem and present it in class, and then to work under the course instructor and a mentor to resolve the problem. Kevin's course project was financial malfeasance by Kevin's first mentor. The course instructor and Kevin's peers suggested Kevin should leave that ministry. Kevin left, and Kevin's course instructor approved his replacement mentor. When Kevin's first mentor discovered Kevin's course project was his malfeasance, he retaliated against Kevin by colluding with his friends at Western with an academic coordinator, the instructor, and others to demand Kevin be immediately dismissed from his studies and forced to return to the church with malfeasance under the authority of the mentor Kevin reported in his project. There is no Western Seminary policy that prohibits students from changing their mentor or their recommending church. Western Seminary violated Kevin's First Amendment rights of freedom of religion and the right to pick his own church.

Western Seminary's Student Development Committee included the two disgruntled academic coordinators, Lynn Ruark who had 3 roles (Financial Aid Director, Dean of Men, Director of Student Development Committee), and others who patronized the retaliatory leader. Kevin's two minutes of defense was interrupted by Ruark and Tuck. Tuck told the retaliatory leader Kevin was insubordinate. The financial malfeasance of the ministry leader was concealed from Kevin's parents who were used by the retaliatory leader and his friends on the Committee. Lynn Ruark threatened Kevin if he appealed the suspension he would be dismissed and the retaliatory leader would ex-communicate Kevin. Western Seminary sentenced Kevin to counseling, suspension, and demanded he return to the church under the dishonest and retaliatory leader. Kevin attended nine months of counseling brainwash that he was wicked and evil. Kevin became suicidal.

Others were abused by the retaliatory leader and reported him for his malfeasance and abuses for which he was fired. Kevin was asked to testify, and the ministry national headquarters wrote Western Seminary's President, Bert Downs, that the retaliatory leader had no justified authority over Kevin during that Committee meeting and afterwards, since Kevin had moved on. Kevin appealed to Downs who refused to admit they misjudged Kevin on the word of a false leader and/or the school should not have denied Kevin his right to appeal that is required by DOE financial aid, federal regulations, State laws, school policies, and accreditation policies. Kevin complained to ATS and NWCCU. ATS quickly dismissed Kevin's complaint when Western Seminary hired an attorney, and retracted that. ATS dismissed Kevin's complaint and did not investigate his evidences. Kevin admitted himself into a hospital the next day for a suicide watch.

"Lynn Ruark concealed favorable evidences when he hand selected a jury called a Student Development Committee to judge me in a matter of a few minutes. Mr. Ruark defrauded me into believing he would provide the committee a summary of my evidences, but he omitted them. Mr. Ruark threatened me if I appealed, Western Seminary would dismiss me. Together with the Registrar, Mr. Ruark withheld my student records from me for over four years, and only recently was I given the very brief statement by which I was judged over four years ago. Even though I chose a new church based on recommendations of Dan Britts and a fellow student, Western forced me to return to the malfeasant church I left as my instructor had recommended and approved. My First Amendments rights were extorted from me as well as my $15,000 academic investment and future. My family and I were damaged by Western Seminary's unfair business practices." "The injustice that was carried out by the staff of Western Seminary and Westside Covenant Church against Kevin was merciless and treacherous given the level of trust he had for you. I disagree with the choices, actions, and excuses that were made by Western Seminary in conjunction with Westside Covenant Church . The "disciplinary" actions were forced upon Kevin by a variety of spiritual abuse tactics. Kevin's reputation and schooling was attacked and injured by false and malicious statements from Clark Crebar in conjunction with Sacramento and San Jose Western Seminary staff. I am extremely disappointed in your working to control illegally and withhold unethically Kevin's seminary units. You have tampered with Kevin's education goals and have not kept his best interest in mind." (Jill Ford March 16, 2008)

Clark Crebar Clark Crebar, Pastor

Clark Crebar is a former pastor at a church called Grace Church, Eden Prairie, MN and is now the senior pastor at Community Bible Church, Folsom, CA. He is formally from Westside Covenant Church, West Sacramento, CA.

Crebar is the guy that went out of his way to damage Kevin and to which Western Seminary/ Gary Tuck used. This is for reference as to the business practices of Western Seminary involving anyone that gets in their way.


Gladstone Stevens Gladstone Stevens, School Administrator

Rev. Gladstone H. Stevens, S.S. from St. Patrick's Seminary and University (ATS accreditation). He came to testify at the arbitration and had serious issues and problems with what Western Seminary was doing. His testimony is part of day one. Western claims through Rob Wiggins that any other ATS school agrees with what Western was doing.


Rob Bryceson Rob Bryceson, Pastor

Pastor Rob Bryceson is one of many students at Western Seminary who have sex outside of marriage. Rob is a pastor and the woman he had sex with got pregnant outside of wedlock. In spite of this, he graduated with no problems in 1993 with a MDiv - just like all other students at the school.

This means that not only can you break the so-called "moral code" that only applies to Randy Chapel, but also you can get your partner pregnant outside of wedlock and Western STILL will not do anything.


Holly Vance Holly Vance, friend

Holly Vance was one of several good friends Randy had prior to 2001. Debbie Brumbaugh called her and others up to defame Randy. In the case of Holly Vance Brumbaugh stated, "Randy was a sex addict."

According to Western's portrayal, Debbie Brumbaugh was never being vindictive; Brumbaugh was a "victim."


Shana Chisholm Shana Chisholm, former fiancé of Randy

Randy met Shana during the underlying lawsuit. She waited for him until the lawsuit was over and they got engaged shortly after settlement. As they prepared to get married, Western Seminary proceeded in on screwing Randy over again. This directly led to the failure of the relationship and breaking off of the wedding to be held in Aug 2006. After Randy and Shana had already broken up Shana wrote to Bert Downs and stated the following.

My name is Shana. I was scheduled to be married to Randy Chapel on August 20th of this year in a beautiful ceremony in Napa.

I have known, and loved Randy for many years, and I have seen first hand the trail of devastation that this battle with Western has left in his life. It is devastating for me to see someone that I love suffer all over again as a new battle begins.

Western Seminary is supposed to be a place where people come to learn to be pastors and teachers of God's Word. In addition to learning tangible material, seminary should be a place where students are encouraged, guided, and a place where they feel safe. For my family, my friends, and me who have watched all of this unfold over the years, Western has become a place of deceit, lies and cover-ups, and far from a place of safety. This deception has infiltrated all ranks of the school from the very top, to professors, and administrators. It is very sad to think that students at the school could learn this behavior as they attempt to follow your poor "example".

Reading the letters that you all have written to Randy, makes me want to scream from the rooftops about how Western does not represent a place where God is working. Instead, Western is a place where the staff and board are more interested in keeping face, than honoring God. In Proverbs 8:13 (and countless other verses), God states that He hates pride and arrogance. You may not realize now, but your actions are doing more to push people from God, than they are to drive them on to dependence and trust in God. For a Seminary, that is an appalling reality.

At this point, many people already know the truth, and have downloaded materials. This continued harassment will cause even more people to know the truth behind what is really happening at the school and in the administration. Believing that you are above the law simply because you are a Seminary does not excuse this behavior.

Please know that this is no longer just about Randy, as the effects of your choices are rippling through me, and our families. As teachers and examples of God, own that responsibility by making steps towards a resolution.

This pissed off Western to no end because they had been confronted for their wrongdoing. Western demanded this to be removed from the public viewing.


Jane Doe Jane Doe, girl who was molested by Steve Korch

Jane Doe is the girl who was molested by Steve Korch in 1975 when she was 16 years old.

There is no dispute to this.


Ted Slaeker Ted Slaeker, Pastor

Ted Slaeker is the pastor at First Baptist Church of Junction City ("We Exist to Honor and Glorify God"). He was holding a retreat where Steve Korch was speaking. Gary Correll and Grant Smith performed a search and found out what kind of guy Steve Korch really was and they started asking questions. Western would attempt to block any testimony from the Oregon witnesses claiming that it was a religious event and covered under penitent-clergy privilege. Western, the defendants and the attorneys got hit with a $1925 (CCP §128.7) fine by the court over this.


Michael Hoch Michael Hoch, Pastor

Michael Hoch was the associate pastor who was handling the event. At first he was willing to talk, but then refused to say any more. That is how things work as we found out. Korch and his attorneys threaten and intimidate people and everyone clams up. On the direction of Western/Phillips, the church refused to turn over materials being subpoenaed until the court intervened.


Grant Smith Grant Smith, Witness

Grant Smith and Gary Correll had a lot of questions about why Steve Korch, a man they did not think should be speaking was speaking at the retreat. This carried over into several emails, which Ted Slaeker failed to produce, but these guys did. Again, those in the church all stuck together to keep the truth about Korch from getting out. Grant Smith was the more talkative and helpful to let us know what was going on behind the scenes. Since Western has won, Grant Smith has not answered anything further.

Bard Marshall Bard Marshall, Pastor

In 2006 Bard Marshall was approached about Steve Korch being ordained in the church at Lincoln City. The church was never made aware of what Korch had done and sent an open letter to Steve Korch and others asking for Korch to step down due to the public sin of Steve Korch's actions.

Korch refused, and instead proceeded to threaten anyone with knowledge.

After the settlement and gagging of Randy and Carol things changed. After that Bard Marshall was telling churches to have Steve Korch speak at their events. Once Randy and Carol were silenced, people went about covering up what Steve Korch had done and pushing him forward as the "Spiritual Leader" of the Baptist church.


Steve Baker Steve Baker, Education Specialist

Steve Baker was a Senior Education Specialist with the Degree Program of the California Bureau for Private Postsecondary and Vocational Education (BPPVE) and was an expert during the arbitration. Matthew Geyer completely ignored what Baker said, unless he could twist it into something else, and Geyer also ignored the State's own documents concerning how Western Seminary could operate in California.

Matthew Geyer Matthew Geyer, Arbitrator

Matthew Geyer was arbitrator. His award violates Federal and State laws, as well as various decisional laws to claim that the agreement and degrees are valid. Basically the award is a work of fiction. The Department has learnt part of the problems Matthew Geyer has created as they relate to FERPA.


Leonard Sprinkles Leonard Sprinkles, Mediator

Superior Court Judge Leonard Sprinkles (ret) acted as mediator. His wife is a partner with Steve Korch's attorney Linda McPharlin. As we would later find out, he was actually spending time helping Western et al use the mediation privileged to cover up the fraud and billing Randy for the time to help out Korch who came with an attorney and was understood as a distinct party under the agreement to mediate. Randy confronted him on what he was doing and he refused to refund the mediation costs.


Mazie Hirono Mazie Hirono, Congresswoman

Cheryl Oldham wrote to Mazie Hirono claiming that the degrees were valid as well as misleading the Congresswoman as to the full extent of the problems related to ATS and NWCCU being out of compliance with 34 CFR § 602 that the Spellings administration was covering up.


Dianne Feinstein Dianne Feinstein, Senator

Randy has had to go to U.S. Senator Dianne Feinstein repeatedly to cause the Department to produce materials. The Department continues to suppress and fail to produce materials to Randy and others.


Anna Eshoo Anna Eshoo, Congresswoman

Randy had to go to Rep. Eshoo to advocate for him and his FOIAs to be processed by the Department.


Gregory L Katz Gregory L Katz, Psychologist

Gregory L Katz saw Randy in 2005 and was the expert witness in the underlying case. In 2005/2006 Randy was psychological turmoil in the severely depressed range. This is how Randy signed the March 14, 2006 Settlement Agreement and everyone knew it. In 2011, Katz provided a second review to show the long-term damage and injury Randy has suffered. Of interest, Katz is the Santa Cruz county psychologist who provides assessment and treatment of sex offenders in the country. Katz was not surprised at the demands and threats of Steve Korch to cover up his 1975 sexual misconduct. Korch's actions betray Korch has never been treated.

Joel is Randy's son. He was born on Feb 7, 2009. Randy has not been with Joel since May 2010. He currently lives with his mother Susan who is divorcing Randy. The last time Randy spoke to Joel was November 2010. Randy has not seen Joel since. Susan with the help of her father Donald Allister and mother Janice Allister have schemed since Oct, 2010 to keep Joel from Randy until Joel was an adult, using the litigation against Randy.

Susan Chapel Susan Allister, Susan Chapel former wife of Randy

Susan now goes by her former surname (Susan Allister).

Susan and Randy met on September 11, 2007 in Edinburgh. They were engaged and married by April 5, 2008. Susan is now in the process of divorcing Randy due to the case. The whole marriage occurred between the letter requesting help from Spellings in March 2007 to current.

Dale, Carol, Justin, Randy's sister Cindy, Kevin Ford and Carol's friend attempted to speak with Susan in order to cause her to not do this. Susan never responded. Carol spoke to Kevin Ford who was also going through a divorce as a direct result of Western Seminary screwing with his life and he wrote. Susan never responded. After Randy was served the divorce papers, Randy called the Allisters and left a message (because no one answered) crying for Susan to not do this to him. Again, Susan never responded. Susan has been encouraged by her family and friends to divorce. While Donald has been recently involved in services where people were renewing their marriage vows, Susan and the Allisters see no reason to encourage Susan to work on her marriage and for months she and the Allisters made no effort to contact Randy - even when they knew that Randy was in pain; even when they knew Randy had cried out for Susan to not do this. This all came down after the award - an award that is a work of fiction and to which Western helped write, knowing full well that positions taken violated federal laws, state laws, decisional cases and their own testimony.

Randy has pleaded with Susan to not go through with the divorce - not to do this. The divorce is scheduled to be degreed in early September. Randy does not know when or if he will ever see Joel again.
